Waterfox Private Search is currently in open beta. Some features mentioned in these terms may be implemented in future updates.

1. Introduction and Acceptance of Terms

Welcome to Waterfox Private Search. By accessing or using our service, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the service.

2. Description of Service

Waterfox Private Search is a privacy-focused meta-search engine that allows users to select which search engine to receive results from. We strive to provide unmodified search results from these providers, but we do not guarantee the accuracy, completeness, or usefulness of any search results.

3. User Registration and Account Security

You may need to create an account to access certain features once they become available. You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.

4. Service Plans and Usage

During the beta period, Waterfox Private Search is available free of charge with advertisements provided directly by us to support development efforts. We plan to introduce paid subscription options in the future that will remove advertisements.

We reserve the right to limit or suspend service if we determine that usage is excessive or abusive. Automated or programmatic use of the service is prohibited unless explicitly authorized by Waterfox Private Search.

5. User Conduct and Prohibited Activities

You agree not to use the service for any unlawful purpose or in any way that interrupts, damages, or impairs the service. Prohibited activities include but are not limited to:

  • Attempting to bypass usage limitations
  • Using automated tools or scripts to perform searches without our express permission
  • Redistributing or reselling search results
  • Impersonating another person or entity
  • Interfering with or disrupting the service or servers or networks connected to the service

6. Intellectual Property Rights

The service and its original content, features, and functionality are owned by Waterfox Private Search and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

7. Privacy and Data Protection

Your use of Waterfox Private Search is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding the collection and use of your information.

8. Payment Terms

When paid plans become available, subscription fees will be billed in advance on a monthly basis. You will be required to pay all fees associated with your chosen plan.

We reserve the right to change our pricing at any time. If we do so, we will provide notice of the change on our website or via email at least 30 days before the change takes effect.

9. Limitation of Liability

In no event shall BrowserWorks Ltd, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

10. Disclaimers and Warranties

Your use of the service is at your sole risk. The service is provided on an "AS IS" and "AS AVAILABLE" basis. The service is provided without warranties of any kind, whether express or implied.

11. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion.

14. Changes to the Service

We reserve the right to withdraw or amend our service, and any service or material we provide via Waterfox Private Search, in our sole discretion without notice. This includes adding or removing search engine options. We will not be liable if for any reason all or any part of the service is unavailable at any time or for any period.
